Supplemental Terms of Use for Microsoft Azure Previews

Azure may include preview, beta, or other pre-release features, services, software, or regions offered by Microsoft to obtain customer feedback ("Previews"). Previews are made available to you on the condition that you agree to these terms of use, which supplement your agreement governing use of Azure.

PREVIEWS ARE PROVIDED "AS-IS," "WITH ALL FAULTS," AND "AS AVAILABLE," AND ARE EXCLUDED FROM THE SLAS AND LIMITED WARRANTY. Previews may not be covered by customer support. Previews may be subject to reduced or different security, compliance and privacy commitments, as further explained in the Microsoft Azure Privacy Statement, Microsoft Azure Trust Center, and any additional notices provided with the Preview. We may change or discontinue Previews at any time without notice. We also may choose not to release a Preview into "General Availability."

The following additional terms are applicable to the named Preview features below:

Azure Media Services Content Protection Service

As a condition to using the Azure Media Services Content Protection Service during Preview, you are required to report to Microsoft the name of all services (brand name or trademark name) for which you or your End Users protect content using the Azure Media Services Content Protection Service. This requirement pertains to each Azure Media Services Content Protection Service account that you create, and you must report and update such branding information using the reporting mechanism provided in the Portal. We reserve the right to suspend or disable your use of the Azure Media Services Content Protection Service if you provide incorrect information or if you fail to continuously update your information through the Portal.

Portal Preview

The new Portal Preview includes access to Visual Studio Online, your use of which is conditioned upon your acceptance of the Microsoft Developer Services Agreement and the Microsoft Developer Services Privacy Statement.

Azure Import/Export Services

Your use of the Import/Export Service is conditioned upon your compliance with all instructions provided by Microsoft with respect to the preparation, treatment and shipment of the physical media containing your data, which will be provided to you via email or at http://go.microsoft.com/fwlink/?LinkID=301900. You are solely responsible for ensuring the storage media and data are provided in compliance with all laws and regulations. All incoming storage media will be shipped DDP data center (INCOTERMS 2010), and you are responsible for all costs of shipping and carriage, including without limitation insurance, customs declarations, import and export declarations, taxes, duties and fees.

Exported storage media will be shipped Ex Works data center (INCOTERMS 2010) and you are responsible for all costs of shipping and carriage, including without limitation insurance, customs declarations, import and export declarations, taxes, duties and fees. You are responsible for ensuring that the data exported on storage media is permitted to be shipped to the location you provide.

No Liability for Storage Media

You agree that Microsoft has no duty with respect to the storage media and the data contained therein and no liability for lost, damaged or destroyed storage media. You are solely responsible for taking any precautions to protect the storage media and data contained therein, including without limitation: encrypting data, tamper-proof packaging, shipping insurance, data backup, and data redundancy.
