Supplemental Terms of Use for Microsoft Azure Previews

Azure may include preview, beta, or other pre-release features, services, software, or regions offered by Microsoft to obtain customer feedback ("Previews"). Previews are made available to you on the condition that you agree to these terms of use, which supplement your agreement governing use of Azure.

PREVIEWS ARE PROVIDED "AS-IS," "WITH ALL FAULTS," AND "AS AVAILABLE," AND ARE EXCLUDED FROM THE SERVICE LEVEL AGREEMENTS AND LIMITED WARRANTY. Previews may not be covered by customer support. Previews may be subject to reduced or different security, compliance and privacy commitments, as further explained in the Microsoft Online Services Privacy Statement, Microsoft Azure Trust Center, the Online Services Terms, and any additional notices provided with the Preview. Certain named Previews may also be subject to additional terms set forth below, if any. We may change or discontinue Previews at any time without notice. We also may choose not to release a Preview into "General Availability."

Azure Data Lake (Store & Analytics)

In order to help provide the best possible experience for our preview participants, and to help us solicit critical feedback we can use to improve the service, we are limiting participation in the Azure Data Lake preview. While we are generally using a first come/first considered methodology in selecting participants, we reserve the right to select participants based on relevant criteria. Examples of criteria we may use include desired data center location for Azure Data Lake accounts, anticipated dataset sizes and job parallelism, and historical consumption of Azure services. We also reserve the right to remove participants from the preview who are infrequently using their Azure Data Lake accounts or have otherwise indicated, implicitly or explicitly, that they are no longer interested in actively participating in the preview. By applying to join and participating in the preview, you are consenting to Microsoft contacting you about your qualifications for the preview, your use of the preview services (including to obtain your feedback about the preview services), and your plans to continue participating in the preview.

Microsoft Cognitive Services

Microsoft Cognitive Services are specialized machine learning and knowledge services. You may use the Bing Speech API, Emotion API, Face API, Language Understanding Intelligent Service (LUIS), Speaker Recognition API, and Web Language Model in accordance with the use, privacy, data, security, and other terms in parts B, C, and D of the Microsoft Cognitive Services Preview Terms at https://go.microsoft.com/fwlink/?LinkId=533207&clcid=0x409 and the Microsoft Privacy Statement at https://go.microsoft.com/fwlink/?LinkId=521839&clcid=0x409. As further described in these parts of the Microsoft Cognitive Services Preview Terms, you give us permission to use Customer Data to improve Microsoft products and services. For example, we may improve our underlying algorithms and models over time based on content you or your end users provide to the service. These services provide no means for you to access or extract Customer Data and Microsoft has no obligation to delete Customer Data received by these services. You may not use these services in connection with Customer Applications that are used by or targeted to children under the age of fourteen. Power BI Embedded

You may use the Power BI Embedded service within an application you develop only if your application (1) adds primary and significant functionality to our service and is not primarily a substitute for any Power BI service, and (2) is provided solely for external users. The term “external users” has the meaning set forth in the Online Service Terms. You may not use the Power BI Embedded service within internal business applications.

Power BI Embedded includes use of Bing Maps. Any content provided through Bing Maps, including geocodes, can only be used within the Power BI Embedded service. Your use of Bing Maps is governed by the Bing Maps End User Terms of Use available at http://go.microsoft.com/?linkid=9710837 and the Bing Maps Privacy Statement available at https://go.microsoft.com/fwlink/?LinkId=248686&clcid=0x409.

Azure Media Services H.265/HEVC Encoding

Customer must obtain its own patent license(s) from any third party H.265/HEVC patent pools or rights holders before using Azure Media Services to encode or decode H.265/HEVC media.
